MAE GWEINIDOGION CYMRU yn hysbysu eu bod wedi penderfynu bod y cynnig i atgyweirio Pont Afon Ebwy yr M4(y "Prosiect") yn brosiect perthnasol o fewn yr ystyr a roddir i "relevant project" yn adran 105ZA(2)o Ddeddf Priffyrdd 1980 (fel y'i diwygiwyd) ond na fydd yn ddarostyngedig i Asesiad o'r Effarth Amgylcheddol ("AEA") yn unol ag adran 105Ao Ddeddf Priffyrdd 1980 (fel y'i diwygiwyd) a ChyfarwyddebyCE2014/52/EU (a oedd yn diwygio Cyfarwyddeb 2011/92/EU) (y "Gyfarwyddeb").
Maent hefyd yn hysbysu bod Asesiad o'r Goblygiadau ar gyfer Safleoedd Ewropeaidd o dan reoliad 63 o Reoliadau Cadwraeth Cynefinoedd a Rhywogaethau 2017 ac Erthygl 6(3) o Gyfarwyddeb Cynefinoedd 92/43/EEC wedi ei gynnal i asesu goblygiadau'r Prosiect ac i bennu unrhyw effeithiau andwyol y gallai eu cael ar integredd amgylcheddol afon Ebwy ac afon Wysg.
Bydd y Prosiect yn golygu gwneud gwaith ymyrryd brys i Bont Afon Ebwy yr M4. Gan nad yw'r gwaith arfaethedig fel y cyfryw yn waith gwella nac yn waith cynnal a chadw o dan Ddeddf Priffyrdd 1980 (fel y'i diwygiwyd), fel mesur rhagofalus, mae wedi ei sgrinio ar y sail ei fod yn waith gwella.
Ar CI ystyried y meini prawf dethol a nodir yn Atodiad III i'r Gyfarwyddeb ac o ganlyniad i'r rhesymau a'r mesurau rheoli a nodir isod, mae Gweinidogion Cymru wedi penderfynu nad yw'n debygol y bydd y Prosiect yn cael effaith andwyol sylweddol ar yr amgylchedd ac nad oes angen AEA.
Bydd llunio a chadw at Gynllun Rheoli Amgylcheddol Adeiladu ("CRhAA"), a fydd yn defnyddio canllawiau a thechnegau arferion gorau, yn atal unrhyw effeithiau andwyol sylweddol tebygol ar ansawdd aer, svVn neu wastraff. Bydd y CRhAA hefyd yn gweithredu mesurau i leihau'r risg o lygredd yn y cwrs dvVr neu gerllaw iddo.
Bydd Trwydded Gweithgarwch Perygl Llifogydd, a fydd yn cael cydsyniad ar wah3n drwy Gyfoeth Naturiol Cymru ("CNC"), yn ofynnol ar gyfer gwaith o fewn afon Ebwy. Yn ogystal, dyroddwyd Datganiad Dull Gwaith rhagofalus i Gyngor Dinas Casnewydd sy'n nodi na fydd y gwaith yn effeithio ar integredd Safle o Bwysigrwydd er Cadwraeth Natur afon Ebwy. Ni fydd y gwaith ychwaith yn effeithio ar dymor mudo eogiaid a chytunwyd ar y gwaith gydag CNC.
Bydd llystyfiant, gan gynnwys y coetir a'r coed ger pileri'r bont, yn cael ei glirio i ddarparu ar gyfer ardal y gwaith arfaethedig. Cynhaliwyd arolygon Rhywogaethau a Warchodir gan Ewrop i hysbysu'r gwaith dirio ac mae CNC wedi dyroddi trwydded Pathewod ar gyfer y gwaith. Bydd Clerc Gwaith Ecolegol yr cael ei gyflogi drwy gydol y Prosiect i gynnal gwiriadau rhywogaethau cyn i waith gael ei wneud sy'n effeithio ar nodweddion cynefinoedd addas. Mae'r gwaith yn cynnwys trin Clymog Japan i sicrhau nad yw ei rychwant yn cynyddu o ganlyniad i'r gwaith. Bydd yr ardaloedd lie y bydd llystyfiant yn cael ei glirio yn cael eu hailblannu ag amrywiaeth well o Iwyni a choed brodorol ar ddiwedd y gwaith.

ENVIRONMENTAL IMPACT ASSESSMENT NOTICE OF DETERMINATION IN ACCORDANCE WITH SECTION 105 AB(1)(B) OF THE HIGHWAYS ACT 1980 (AS AMENDED)
ASSESSMENT OF IMPLICATIONS FOR EUROPEAN SITES
NOTICE OF STATEMENT TO INFORM AN APPROPRIATE ASSESSMENT IN ACCORDANCE WITH REGULATION 63 OF THE CONSERVATION OF HABITATS AND SPECIES REGULATIONS 2017 (AS AMENDED)
THE WELSH MINISTERS give notice that they have determined that the proposal to repair the M4 Ebbw River Bridge (the "Project") is a relevant project within the meaning of Section 105ZA(2)of the Highways Act 1980 (as amended) but will not be made subject to an Environmental Impact Assessment ("EIA") in accordance with Section 105Aof the Highways Act 1980 (as amended) and EC Directive 2014/52/EU (which amended Directive 2011/92/EU) (the "Directive").
They also give notice that an Assessment of Implications for European Sites under Regulation 63 of the Conservation of Habitats and Species Regulations 2017 and Article 6(3) of the Habitats Directive 92/43/EEC has been undertaken to assess the implications of the Project and establish any adverse effects it could have on the environmental integrity of the Ebbw River and the River Usk.
The Project will comprise the implementation of urgent intervention works to the M4 Ebbw River Bridge. As the proposed works are strictly neither 'improvement' nor 'maintenance' works under the Highways Act 1980 (as amended), as a precautionary measure, they have been screened on the basis that they are 'improvement works.
Following consideration of the selection criteria set out in Annex III of the Directive and as a result of the reasons and control measures set out below, the Welsh Ministers have determined that it is not likely that the Project will have a significant adverse effect on the environment and that an EIA is not required.
The production of and adherence to a Construction Environmental Management Plan ("CEMP"), which will utilise best practice guidance and techniques, will prevent any likely significant adverse effects to air quality, noise or waste. The CEMP will also implement measures to minimise the risk of pollution in or near the watercourse.
Works within the Ebbw River will require a Flood Risk Activity Permit, which will be consented separately through Natural Resources Wales ("NRW"). Furthermore, Newport City Council has been issued with a precautionary Method of Works Statement that outlines that the works will not affect the integrity of the Ebbw River Site of Importance to Nature Conservation. The works will also not impact the salmon migration season and have been agreed with NRW.
vegetation including the woodland and trees beside the bridge piers will be cleared to accommodate the proposed works area. European Protected Species surveys have been undertaken to inform the clearance works and a Dormouse licence for the works has been issued by NRW. An Ecological Clerk of Works will be employed for the duration of the Project to undertake species checks ahead of works affecting suitable habitat features. The works include the treatment of Japanese Knotweed to ensure its extent does not increase as a result of the works. The areas where vegetation clearance will be undertaken will be replanted with an improved diversity of native shrubs and trees at the end of the works.
